Under Canadian law, a marriage is considered to have broken down when spouses have lived separate and apart for at least one year, or if one spouse has committed adultery or cruelty making cohabitation intolerable.
Before a divorce can be finalized, the court must be satisfied that:
Parenting arrangements, including access and decision-making, are in place
Child support and spousal support have been arranged
Property has been divided and equalized
To apply, you will need a Separation Agreement or relevant Court Orders, and your original or certified marriage certificate.
